https://www.greenindiacare.com (“The Website” or “Platform” or “GIC” or "we"
or "us" as the context requires, which term shall be deemed to individually and
collectively include its related entities and persons controlling or owning the
Website, content over the same and related hereto). GIC owns and operates the
services provided through the Website.
GIC is a leading global Agro-tech company, who enhance standards of Agricultural
through innovation. GIC pledges to provide effective pesticides to our farmers. We
feel our end users are the best friends who understand and acknowledge our
valuable products. We together try to keep our motherland Green and Clean. We
are in the business of manufacturing of Agro Chemicals Including All Kind Of
Pesticides, Insecticides, Herbicides, Plant Growth Regulators (PGRs) And Other
Customized Nutritional Products For Plants.
The following Terms of Use apply to all users of GIC and its website If there are
terms which do not fit into Your criteria, then You should stop using the website,
application or any other of our products and services with immediate effect.
1. DEFINITIONS
1.1. “Blog” shall mean and include creative content posted by GIC onto
GIC platform;
1.2. “Complaint” shall mean an intimation sent by
User/Dealer/Visitor/Purchaser for any grievance suffered;
1.3. “Content” shall mean and include the content on the Platform
including product descriptions;
1.4. “Creative content” shall mean content posted by GIC onto its
platform in form of Blogs, creative lines/catch lines/logos over the
GIC platform;
1.5. “Dealer” shall mean an entity interested in purchasing GIC products
including bulk purchases and/or entity which has submitted the
Dealership Enquiry form as available on the GIC website;
1.6. “GIC” shall mean Green India Care;
1.7. “Person/User” shall mean any individual (including personal
representatives, executors or heirs of a deceased individual) or legal
entity, including but not limited to, any partnership, joint venture,
corporation, trust, unincorporated organization, limited liability
company, limited liability partnership and governmental authority,
simply accessing/browsing website or view the content as accessible
thereon;
1.8. “Products” shall mean all Herbicides, Insecticide, Fungicides, Bio
Pesticides, PGR, Sprayers, Household etc., as added and amended
from time to time.
1.9. “Server” shall mean secured files stored on a VPC(Virtual Private
Server)/ Dedicated. All the details regarding products, users, are
stored on Relational Database(MySQL) architecture and the site is
secured with SSL Certificate.
1.10. “QC Lab” shall mean quality control labs;
1.11. “You” shall mean and include a Dealer, purchaser of products and/or
a person browsing the website, as the context specifies herein.
1.12. The said list of definitions is not exhaustive.
2. OUR PLATFORM
1.1 GIC is a platform offering wide range of Agro-based products to users
which helped to to generate high productivity, on existing piece of land in
the same gestation period.
1.2 GIC in its Agro-Chemical products, input efficient technology, so that
You could generate maximum output at minimum input.
1.3 GIC has minimal usage of carbon products which takes your farming
towards organics and is one step towards sustainability.
1.4 GIC has more than 3 Manufacturing Unit in India, each more than 50,000
sq. feet. GIC has the largest installed capacity for Agro-chemical
products, Granules and PGR Facility in India
1.5 Users by viewing from a wide varierty of Agro based products can place
orders, enquire for bulk purchase and enquire for dealership prospects.
1.6 By accepting this Agreement, you affirm that you are 18 years of age or
above and are fully competent to enter into this Agreement, and to abide
by and comply with this Agreement.
3. APPLICABLE TERMS
2.1 Your use of this website is subject to these terms including privacy policy
and other policies present which may be updated from time to time from
the date of publication over the website (together, this ‘Agreement’).
4. CONSENT
3.1 When you use GIC website, the terms and conditions and the policies
over the website, are all agreed and bound. As the website is used, you
are bound by the said agreement. If there are terms which do not fit into
your criteria, then you should immediately stop using the website.

Application Form, available on the website wherein the following
information marked in (*) shall be required to be uploaded:

4.1.5 Mobile No.;
4.1.6 Main Contact Person;
4.1.7 Email Address;
4.1.8 Nature of Organization;
4.1.9 Company GST No.;
4.1.10Fertilizers License No.;
4.1.11Insecticides License No.;
4.1.12Seeds License No.;
4.1.13Any Special achievement;
4.1.14Capital Currently invested in business;
4.1.15Amount willing to be invested in stocks; and
4.1.16Total Strength of Staff.
4.2 Bankers Details
4.2.1 Name;
4.2.2 Address;
4.2.3 Account Number;
4.2.4 Telephone Number;
4.2.5 Email Address;
4.2.6 Any bank facilities enjoyed;
4.2.7 Type of facility; and
4.2.8 Appropriate number of farmers in your area.
4.3 After receiving the B2B Enquiry application, GIC shall assess each forms
and verify details provided by you. Upon successful verification,GIC
shall request a security to be deposited by You either through a
Cheque/Demand Draft, prior to initiating any order.
4.4 Upon successfully deposit as aforementioned, the order shall be
dispatched .
5.1 Terms of use regulates the Privacy Policy. When you access or use our
website, you need to abide by the guidelines and policies stated in the
privacy policy. For any information related to the privacy policy you can
visit the Privacy Policy.
7. INTELLECTUAL PROPERTY RIGHTS
6.1. The contents on the website including the logos, creative content,
products, style, color, layout, design, are the trademark are
copyright/trademark and IP ownership of GIC and follows the
country laws with international conventions and standards.
6.2. No license or right is granted and Your use of and/or the website
therein shall not constitute by implication, estoppel or otherwise,
any license or right of use.
6.3. You shall not download or encourage others to download
copyrighted works, trademarks, or other proprietary information
without obtaining the prior written consent of GIC. In the event of
infringement GIC shall on its own sole discretion take necessary
steps.
6.4. If there is any objection to any content on the website or if any
illegal usage is found, GIC should be immediately contacted and
the same shall be reported to office@greenindiacare.com for prompt deletion of
such content.
8. COPYRIGHT PROTECTION
7.1. We take copyright and related IP infringements very seriously. If
you feel your copyright has been violated and the same does not
qualify under Copyright exceptions as per law, you may notify us
and raise your concern by sending us an intimation at
office@greenindiacare.com . The intellectual property rights of the users at GIC
strive to act quickly at all such intimation.
7.2. You may not upload, embed, post, email, transmit or otherwise
make available any content that infringes any copyright, patent,
trademark, trade secret, privacy, publicity or other proprietary
rights of any person or entity.
7.3. Any failure to comply with the given requirements in the section
would make your intimation to us, invalid which shall be agreed by
you.
9. INFRINGEMENT INDEMNITY
8.1 GIC is not liable for any claims related to losses or damages including
costs and expenses of attorney fees as well which might arise from: (i)
your use of the service; (ii) your violation of any terms of these Terms of
Use or policy; or (v) any misuse by the user of the website.
10. LINKS TO THIRD-PARTY WEB SITES
9.1 Links to third-party web sites, if any, are provided for convenience only
and do not imply any approval or endorsement by the Company of the
linked sites, even if they may contain the Company’s logo, as such sites
are beyond the Company’s control. Thus, the Company cannot be held
responsible for the content of any linked site or any link contained
therein.
11. SETTLEMENT OF DISPUTES
10.1 GIC should be the first point of contact to resolve or attempt to resolve
any dispute.
10.2 In case of failure to settle the disputes amicably within 30 days, the
same shall be finally settled under the Arbitration and ConciliationAct 1996 of India by appointing
two Arbitrators, one by each party and a
Presiding Arbitrator to be appointed by the said Arbitrators.
10.3 The seat of Arbitration shall be Delhi and within the Jurisdiction of
the Court of Law at New Delhi, India.
10.4 The arbitrator nominated by GIC shall be an independent advocate,
having minimum of 4 years of experience as practicing advocate.
10.5 The Arbitration shall be conducted in English language. The award
given by the arbitrator shall be final and binding upon the parties
including costs of proceedings.
10.6 Or in any other manner being sole discretion of GIC, which suits the
subject matter, as per dispute.
12.DISCLAIMER
11.1 By using GIC, you give your consent that any reliance on any opinion
or statement or advice or information is at your own risk and not be taken
against GIC for legal or personal purposes. GIC holds the right in sole
discretion to edit or omit any part of the website or rectify the errors of
GIC website. No prior notice would be given by GIC for any change of
any aspect of the website including the content and product on the
website.
11.2 Your Use of this Website is at Your Sole Risk. The Site is provided on
an “As Is” and “As Available” Basis. While GIC makes every reasonable
effort to ensure that Information contained within is Correct, Information
may be Incomplete, Inaccurate Or May have become out of date and

mentioned outside of the TOU. GIC or its affiliates are not liable for
warranties which include the merchantability not mentioned in the TOU.
14.2 GIC is not liable for any losses or damages in any circumstances
which is caused by:
14.2.1 Errors, mistakes or inaccuracies on the service
14.2.2 Any unauthorized use of service;
14.2.3 Any content uploaded submitted by a user, including your use of
content;
14.2.4 The removal or unavailability of content; AND/OR
14.2.5 Action irrespective of the claim otherwise permitted under law.
15.1 None of the conditions or provisions of these Terms of Use or any
other agreement including the privacy policy, shall be held to have been
waived by any act or knowledge on the part of either party, except by an
instrument in writing signed by a duly authorized officer or representative
of such party and duly received and expressly consented in writing by the
other party. Further, the waiver by either party of any right hereunder or

of any other rights hereunder or any breach or failure of performance of

17. GENERAL TERMS
16.1 The terms of use comprise of the entire agreement between GIC and
the user. The entire oral and written communication along with negotiations and proposals made
outside of it is replaced by the
agreement.
16.2 GIC is not liable for failing to fulfill the obligations which results in
circumstances that are beyond control.
16.3 The failure of GIC to exercise or enforce any right or provision of
these Terms of Use shall not constitute a waiver of such right or
provision. If for any reason a court or authority finds that any provision or
portion of these Terms of Use is unenforceable, the remainder of these
terms will continue in force and effect.
18. SEVERABILITY
17.1 The Terms of Use operates to the fullest extent permissible by law. If
any provision of the Terms of Use is held by a tribunal/court of
competent jurisdiction to be unenforceable under applicable law, such
provision shall be deemed severable and excluded from the Terms of Use
and the remainder of the Terms of Use shall be valid and enforceable and
interpreted in accordance with its terms at any rate. However, in such
event, the Terms of Use shall be interpreted so as to give effect, to the
greatest extent consistent with and permitted by applicable law, to the
meaning and intention of the excluded provision as determined by such
court of competent jurisdiction.

18.4.1 Redress intimations received within one month from the date of
receipt of the said complaint sent to us through email or mail;
18.4.2 Dispose off such intimations received within a period of fifteen
days from the date of its receipt;
18.4.3 Receive and acknowledge any order, notice or direction issued by
the Appropriate Government, any competent authority or a court of
competent jurisdiction;
18.4.4 Within twenty-four hours from the receipt of an intimation
received made by an individual or any person on his behalf, in
relation to any content which is prima facie in the nature of any
material which exposes the private area of such individual, shows
such individual in full or partial nudity or shows or depicts such
individual in any sexual act or conduct, or is in the nature of
impersonation in an electronic form, including artificially morphed
images of such individual, take all reasonable and practicable
19.1 The Terms OF Use (along with the PP) constitutes the entire
agreement between You and GIC regarding the use of the Website.

existing laws/regulations/ other governing regulations as applicable on the
said date. We may update our Terms of Use from time to time. Thus, you
